Dan Altstatt, a resident of Sacramento for 20 years, was slammed with a $573,000 nice from the town for nuisance violations dating again to 2014 after a neighbor complained.

He was additionally cited for leaving fruit from his orange and grapefruit timber on the ground.

With the six-figure penalty, Alstatt feared that his residence can be seized.

He triggered the violation when he parked a van and some other automobiles in his backyard, the Sacramento Bee reported in 2022

Five of the automobiles he'd inherited after his brother passed away.

Alstatt worked on the previous van in the grass, which was a further code violation, costing him $250 per day.

In 2015, Alstatt acted as his lawyer in court towards the town and was tangled in a legal battle with them until April of 2022, when he misplaced the case.

The state argued that the town acted legally, even after Altstatt's argument that the fines infringed on his rights as a property owner.

In accordance with the Sacramento City Express, Altstatt denied entry to metropolis inspectors, and that he was not subject to local, state, or federal legal guidelines.

The outlet wrote that neighbors complained that Altstatt's property had grow to be a health hazard, saying it "had turn into a harborage for rats."

Shortly after the complaints started pouring in, the town issued him a notice to abate the nuisances, "which included storage and accumulation of junk and particles," along with the automobiles.

Appeals Decide Louis Mauro wrote within the ruling that Alstatt lacked enough proof, and did not budge after he argued that the "extreme" fines would render him homeless.

"Defendant's argument is unfocused and troublesome to discern," the ruling read.

Mauro referenced a case from San Francisco in 2000 where the town fined a resident $663,000 as a precedent for not being constitutionally excessive.

"That the town can cost such exorbitant and unreasonable fees for having issues in the backyard is beyond belief," Alstatt wrote to the Bee.

"I don't understand how they're able to do that. It is perplexing how disputed allegations of so-called 'junk and debris' in a person's yard can escalate to the purpose where the town owns your property."

He pledged to take the case to the California Supreme Court, and if all else fails, he'd take it to the U.S. Supreme Courtroom.

The action is presently pending.
